Terms of Service
These Terms of Service ("Terms") govern your use of ApexDepths, a music exploration product operated by bigSIMPLE Development LLC ("we," "us," "our"). By creating an account or using the service, you agree to these Terms. If you don't agree, please don't use ApexDepths.
1. The Service
ApexDepths helps you build "depth profiles" — combinations of artists, genres, and a depth score from mainstream (0) to deep cuts (100) — and generate music playlists from those profiles. When you choose to connect your YouTube account, ApexDepths can publish those playlists to your YouTube account on your behalf.
You can also turn on new release alerts for a depth profile. ApexDepths then checks MusicBrainz for new albums, EPs, and singles by that profile's artists and in its genres, and lists the matches in your "New for you" feed. The free plan includes alerts on one depth profile; Premium includes alerts on all of your profiles.
The service is provided as-is. We may add, change, or remove features at any time.
2. Your Account
To use ApexDepths, you need an account. You're responsible for keeping your login credentials confidential and for all activity under your account. You must be at least 13 years old to create an account. If we learn that an account belongs to someone under 13, we will close the account and delete its data. If you're under the age of majority in your jurisdiction, you confirm that a parent or guardian has reviewed these Terms.
You agree to provide accurate information when creating your account and to keep it up to date.
3. Acceptable Use
You agree not to:
- Use ApexDepths to violate any law or the rights of others
- Reverse-engineer, decompile, or attempt to extract our source code, except as permitted by applicable law
- Use the service to send spam, malware, or to harass others
- Attempt to gain unauthorized access to other users' accounts or to our systems
- Use automated tools to scrape, crawl, or extract data from the service beyond what's offered through the public app interface
- Use the service to infringe copyright, trademark, or other intellectual property rights
- Interfere with or disrupt the service, including by overloading it with requests
We may suspend or terminate accounts that violate these rules.
4. Third-Party Services
ApexDepths integrates with third-party services, including MusicBrainz, Last.fm, YouTube (Google), and Anthropic's Claude API. Your use of these services through ApexDepths is also subject to their own terms of service:
When you connect your YouTube account, you authorize ApexDepths to create playlists in your YouTube account on your behalf. You can revoke this authorization at any time from Depth Profile Details → Disconnect YouTube in the app, or directly at https://myaccount.google.com/permissions. We do not read, modify, or interact with any YouTube data beyond creating the playlists you request.
By using YouTube features in ApexDepths, you also agree to be bound by the YouTube Terms of Service.
5. Content and Intellectual Property
Your content. Depth profiles and playlists you create are yours. We don't claim ownership of them. By creating playlists in your YouTube account through ApexDepths, you're publishing content under your own YouTube account, governed by YouTube's terms.
Our content. The ApexDepths app, name, logo, and original software are the property of bigSIMPLE Development LLC and protected by copyright and other intellectual property laws.
Catalog data. Artist and track metadata is provided by MusicBrainz and Last.fm under their respective licenses. We don't claim ownership of this data.
6. Subscriptions and Payments
ApexDepths has a free plan. You can also pay for the items below. All prices are in US dollars.
Subscriptions and upgrades are purchased on our website. The iOS and Android apps don't sell them, and purchases made on the website work in the apps.
Monthly subscriptions
- Premium — $6.99 per month.
- Extra playlist hours — $0.99 per month for each level, up to two levels. Each level raises your playlist length limit by one hour, to a maximum of 4 hours.
- Auto-generate scheduler — $0.99 per month. Turns on scheduled playlist generation for one depth profile.
- Automatic renewal. Each subscription renews automatically every month and charges the payment method on file at the then-current price until you cancel.
- Cancel any time, online. You can cancel from the Manage Plan page on the ApexDepths website (depths.bigsimple.dev), or by emailing us. Cancellation stops future renewals. The subscription stays active until the end of the period you have already paid for, and we don't charge again after that. The charge for that period stands: cancelling doesn't refund or prorate it. We email you to confirm each cancellation.
- Levels past the maximum. If you subscribe to an extra playlist hours level when you already have two, the extra level isn't applied. We set that subscription not to renew, so it ends at the end of its first billing period. Its first charge isn't refunded or prorated.
- Price changes. We will email you at least 30 days before a price change takes effect on your subscription. You can cancel before then to avoid the new price.
One-time purchases
- $0.99 each: an extra depth profile slot or one Last.fm history import.
- These are single payments. They don't renew, and you won't be charged again unless you buy another.
General
- Payment. Payments are processed by Stripe under their terms. We never see or store your full card details.
- Refunds. We don't give full or partial refunds for a billing period you have already paid for, including when you cancel during it. Other refunds are provided at our discretion, except where required by law.
7. Privacy
Your privacy matters. Our Privacy Policy explains what data we collect and how we use it. By using ApexDepths, you agree to the practices described there.
8. Termination
You can close your account at any time from Settings → Delete Account in the app, or by emailing us. Closing your account triggers our deletion cascade: your depth profiles and new release alerts are deleted, your YouTube tokens are revoked at Google and deleted from our database, and your saved playlists are removed from our records.
We may suspend or terminate your account if you violate these Terms, if required by law, or if we discontinue the service. If we terminate the service entirely, we'll provide reasonable notice and a way to export your depth profiles.
9. Disclaimers
ApexDepths is provided "as is" and "as available." We don't warrant that the service will be uninterrupted, error-free, or that it will meet your specific needs. Catalog data and recommendations come from third-party sources and AI models, and may be inaccurate or incomplete. New release alerts depend on community-maintained MusicBrainz data, so some releases may arrive late, show the wrong date, or not appear at all. We make no warranty about the availability, accuracy, or quality of YouTube videos resolved through the service.
To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by law, bigSIMPLE Development LLC is not liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of ApexDepths. Our total liability for any claim related to the service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) $50 USD.
Some jurisdictions don't allow these limitations; in those places, our liability is limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify and hold harmless bigSIMPLE Development LLC from any claims, losses, or expenses arising from your misuse of the service, your violation of these Terms, or your violation of any third party's rights.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Ohio, USA, without regard to conflict-of-laws principles. Any dispute arising from these Terms or your use of ApexDepths will be resolved in the state courts located in Butler County, Ohio, or in the United States District Court for the Southern District of Ohio, and you consent to the jurisdiction of those courts.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date and notify account holders by email at least 14 days in advance. Continued use of ApexDepths after the effective date of the updated Terms means you accept the changes.
